Larry Grant's book, Death Penalty, depicts a tale of circumstances in the U.S. legal system whereby a jury can release an indicted criminal, even if known to be guilty.
Lodi, WI July 9, 2004 -– Mark is a laid-back lawyer who takes the easy road when it comes to accepting cases – those with a clear verdict and quick pay. One Friday, he's scheduled to appear in the Eagle County courthouse in Denver for the preliminary hearing of his client on an unrelated drug case.
Strangely, he notices Judge Grey, a semi-retired official who supposedly took leave of duty, seated at the bench. Nevertheless, Mark plans to do his time in court and spend the weekend at his friend, Wally Jones', condo in Vail.
Unexpectedly, Mark's case is bumped second when the district attorney, J. Raymond Barlett, and the county sheriff enter the courtroom and make their stand as plaintiff in the case of State of Colorado vs. JACOB JOHNSON.
Johnson stands before the judge with the intention of representing himself; however, Judge Grey refuses to allow him to do so and appoints Mark has his defense attorney -- pro bono.
Accustomed to wealthy drug dealers and well-off upfront paying clients, this is a less than welcomed surprise for Mark who cannot refuse. He soon learns his college rival, Assistant D.A. Daniel Natheson, will be taking the case from Barlett. Armed with the knowledge of his client's circumstances and the political play of Daniel's participation in the suit, Mark knows it's a no-win situation and prepares to drop the case Monday morning.
He doesn't have much to work with on a defense. All investigation reveals Johnson could have avoided killing the inmates. About all Mark can hope for is that the jury will let his client go, even though he's guilty.
Hope all but disappears when Mark discovers that his client was not just some citizen who happened on the scene -- but actively seeking revenge against one of the convicts for having sold drugs to his daughter.
